Terms of service

Agreement

By using Counterspine you agree to these Terms. If you don't, don't use the service. The service is provided by Counterspine SL ("we", "us"). You're "you".

What we do

We aggregate the public takedown record (Lumen, Google Transparency Report, EU DSA Database, USCO, CCB) and provide tools for monitoring, analysis, and counter-notice drafting. We are a tool, not a law firm. We do not provide legal advice.

What you do

  • Provide accurate registration information.
  • Keep your password and API keys confidential.
  • Use the service in compliance with applicable law (GDPR, DMCA, DSA, etc.).
  • Don't abuse the service: no rate-limit evasion, no scraping, no reverse-engineering, no resale of data.
  • Don't use the service to harass, defame, or unlawfully target individuals.

Counter-notices

Counterspine generates §512(g)(3)-compliant counter-notice drafts. Drafts are for your review. You and your attorney are responsible for the content of any counter-notice you actually file. We never auto-file.

Section 512(f) liability

Sending a counter-notice that contains material misrepresentations may expose you to §512(f) liability. We do our best to surface this risk. The final responsibility for any submission is yours.

Subscriptions

Plans are billed monthly via Stripe. 14-day trial requires a credit card. Cancel anytime; cancellation takes effect at the end of the current billing period. No refunds for partial months.

Service-level commitments

We target 99.5% monthly uptime. We do not guarantee specific time-to-alert beyond best-effort. Public-source pipelines depend on third parties (Lumen, Google, EU DSA Database) whose availability we don't control.

Termination

We may suspend or terminate accounts for material breach. Affected users get notice and the opportunity to export their data. We don't terminate for use that is merely inconvenient to us.

Limitation of liability

To the extent permitted by applicable law, our total liability is capped at the amount you paid us in the 12 months prior to the claim. We are not liable for indirect, consequential, or punitive damages, or for the actions of any takedown sender, recipient platform, or third party.

Governing law

These Terms are governed by Spanish law. Disputes are resolved in the courts of Barcelona, Spain, except where applicable consumer law gives you a right to your home jurisdiction.
